In 2012, Judge Berg was nominted by President Barack Obama, and received a confirmation vote from the Senate, for a seat on the United States District Court for the Eastern District of Michigan. 

Prior to his appointment, Judge Berg was a federal prosecutor with the United States Attorney’s Office for the Eastern District of Michigan since 1989, except for a four-year stint when he served as Chief of the High Tech Crime Unit for the Michigan Department of Attorney General. In 2011 he was detailed to the U.S. Department of Justice in the Office of the Deputy Attorney General as a Professional Misconduct Review Unit Attorney.   He served as interim United States Attorney from August 2008 until January 2010.

Prior to government service, Judge Berg was an attorney with the law firm Debevoise & Plimpton and was a law clerk to Judge Anthony Alaimo of the United States District Court for the Southern District of Georgia.
